If you do not agree to these Terms, you may not access or use the Services. We reserve the right to update these Terms at any time; continued use following any update constitutes your acceptance of the revised Terms.
2. Access and Use
Subject to these Terms, HexStellar grants you a limited, non-exclusive, non-transferable, revocable license to access and use the public portions of our website for informational purposes.
Access to HexStellar software, developer tools, and API endpoints is by invitation or application only. Unauthorized access, circumvention of access controls, or use beyond the scope of granted permissions is strictly prohibited.
You agree not to:

- Reverse-engineer, decompile, disassemble, or attempt to derive the source code or underlying architecture of any HexStellar software.

The HexStellar runtime architecture and related core technology are the subject of a Patent Pending application. All rights reserved.
The "HexStellar" and "HXS" names and logos are trademarks of HexStellar. You may not use our trademarks without prior written permission.
Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited access license described above.
4. User Submissions
If you submit information through contact forms, access request forms, or other means, you represent that such information is accurate, and you grant HexStellar a non-exclusive, royalty-free license to use that information to respond to your inquiry and improve our Services.
You may not submit content that is unlawful, defamatory, harassing, infringing, or otherwise objectionable. HexStellar reserves the right to remove any content at its sole discretion.
5. Early Access and Beta Programs
Access to pre-release, beta, or early-access software is provided "as-is," for evaluation purposes only. Early-access users may be subject to additional terms provided at the time of access. Feedback provided during beta may be used by HexStellar without compensation or attribution.
Early-access software may contain errors, may be modified substantially, or may be discontinued without notice.
6. Confidentiality
Any non-public information disclosed to you in connection with early access, partnerships, or evaluations is confidential. You agree not to disclose such information to third parties without HexStellar's prior written consent, and to use it solely for the purpose for which it was shared.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
HexStellar does not warrant that the Services will be uninterrupted, error-free, or free from harmful components. Published benchmarks and performance figures reflect results obtained under controlled conditions; actual results may vary.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEXSTELLAR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
IN NO EVENT SHALL HEXSTELLAR'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
9. Indemnification
You agree to indemnify, defend, and hold harmless HexStellar and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Services; (ii) your violation of these Terms; or (iii) your violation of any third-party rights.

The Services may contain links to third-party websites. These links are provided for convenience only. HexStellar has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites.
11. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the courts located in Delaware.

HexStellar reserves the right to suspend or terminate your access to the Services at any time, for any reason, without notice or liability. These Terms, together with our Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and HexStellar regarding the Services and supersede all prior agreements.
